Andrew Bertrand is appealing his conviction in Mason County Superior Court to two counts of first-degree child molestation. Bertrand was sentenced to 83 months in prison April 6.
According to Bertrand’s counsel Mick Woynarowski of Seattle, “Mr. Bertrand maintains his innocence, and he remains grateful for the continued support of his family and friends.”
Bertrand’s motion for bail on appeal was denied by Mason County Superior Court on April 12.
Woynarowski is the second lawyer for Bertrand — prior counsel withdrew Jan. 14, according to court documents.
“We respectfully disagree with the Mason County Superior Court’s ruling denying our request for a new trial and look forward to appellate review of the case on the whole,” Woynarowski said in an email to the Journal.
Bertrand’s counsel provided objections to the Department of Corrections pre-sentencing information previously reported in the Journal. The defense objected to the “Official Version of Offense,” “Defendant’s Statement Regarding Offense,” “Objection to criminal history section,” “Objection as to “Risk/Needs Assessment” section of PSI report” and “Objection as to “Conclusions”” and “Objection to DOC’s failure to inform the Court as to marginal risk of re-offense.”
“For the reasons stated above, defense asks that the court give the inaccurate and inadequate DOC PSI report no weight and order DOC to include these objections in its permanent files,” the defense objections document reads.
